Uttar Pradesh Right of Way (RoW) Policy – Enabling Seamless Digital Infrastructure

The Uttar Pradesh Right of Way (RoW) Policy, aligned with the Telecommunications Right of Way Rules, 2024, is designed to simplify and accelerate the installation and maintenance of telecom infrastructure across the state. It supports the rapid rollout of 5G, fiber connectivity, and other next-gen digital services critical to Digital India and state-wide e-governance initiatives.

Objectives of the Policy

  • Facilitate hassle-free permissions for telecom infrastructure projects.
  • Promote uniform practices across government departments and urban local bodies.
  • Accelerate digital infrastructure development in both urban and rural areas.
  • Ensure public property and safety are maintained during telecom installations.

What the Policy Covers

Installation of telecom infrastructure such as
  • Underground Optical Fibre Cables (OFC)
  • Mobile towers (including small cells)
  • Overground cable laying
  • Poles, ducts, and related accessories
Applies to
  • Public property: Government buildings, roads, street furniture, etc.
  • Private property: With mutual agreement between landowner and telecom operator

Single-Window Online Portal

All Right of Way applications are processed through the GatiShakti Sanchar Portal:

  • Real-time tracking
  • Dashboard for approvals and pending cases
  • Digital documentation and communication
Time-Bound Approvals
  • Authorities must approve or seek clarification within 45 days.
  • Applications are deemed approved if no response is received within 67 days.
Standardized Charges
  • Charges for RoW permissions are predefined by the government.
  • No additional fees, such as property tax, entry fee, or annuity, can be levied.
  • Bank guarantees, where required, are to be refunded within 30 days post site restoration.
Clarity for Private Land Access
  • Installation on private land requires written consent and mutual agreement.
  • In case of disputes, the District Collector will resolve within 30 days.
  • Landowners have the right to request removal or relocation of infrastructure with proper justification.
Restoration Obligations

Telecom providers are responsible for :

  • Timely completion of works
  • Ensuring public safety
  • Restoring the site to its original condition post-installation
  • Covering any damage compensation
Support for Temporary Networks
  • In case of breakdowns or emergencies, temporary infrastructure can be deployed immediately.
  • Restoration to original infrastructure must be done within 60 to 90 days.
Infrastructure Sharing
  • Encourages common ducts and shared corridors to avoid repeated digging.
  • Public authorities must offer non-discriminatory, cost-based access for shared use of telecom infrastructure.
Responsibilities of Public Authorities
  • Appoint a Nodal Officer for RoW coordination.
  • Ensure timely processing of applications.
  • Prevent arbitrary delays or excessive documentation.
  • Promote transparency and cooperation with telecom licensees.
